These Terms of Service ("Terms") govern your use of pixalba.com, including all related services and interactions. By accessing or using our platform, you agree to comply with these Terms. If you do not agree with any part of these Terms, please refrain from using our services.
1. Definitions
"Pixalba" refers to the platform operated by Pixalba Tech Pvt. Ltd., facilitating photography & Videography service bookings.
"User" refers to any individual or entity using Pixalba’s services, including Photographers and Clients.
"Photographer" refers to professionals offering photography services through Pixalba.
"Videographer" refers to professionals offering videography services through Pixalba.
"Client" refers to users booking photography services via Pixalba.
2. Scope of Services
Pixalba is an online platform connecting Clients with professional Photographers/Videographers. We facilitate bookings, payments, and communication between both parties. However, we do not directly provide photography services or act as an employer for Photographers.
3. User Eligibility & Account Registration
Users must be at least 18 years old to create an account and book services.
Clients and Photographers/Videographers must provide accurate and up-to-date information during registration.
Users are responsible for maintaining the confidentiality of their account credentials.
Pixalba reserves the right to suspend or terminate accounts if any violation of these Terms occurs.
4. Booking & Payment Policy
Clients can select services (Photography/Videography), and book them through Pixalba.
Payments must be made in advance through our secure payment gateway (UPI, net banking, credit/debit cards, etc.).
Pixalba does not accept cash payments directly; all transactions must be processed digitally.
The price displayed at the time of booking is final unless additional services are requested.
5. Cancellation & Refund Policy
Client Cancellations:
Cancellations made at least [X] hours/days before the scheduled event may qualify for a partial refund (subject to a deduction for administrative costs).
Cancellations made within 24 hours/ 2 days of the event are non-refundable.
Photographer/Videographer Cancellations:
If a Photographer/Videographer cancels a confirmed booking, Pixalba will either provide a replacement or issue a full refund.
Force Majeure:
If unforeseen circumstances (e.g., extreme weather, natural disasters, strikes) affect the scheduled shoot, Pixalba will work with both parties to reschedule or provide a refund as deemed appropriate.
6. Responsibilities & Liabilities
Client Responsibilities:
Clients must ensure that all permissions and permits for photography/Videography at their chosen location are obtained.
Clients are responsible for ensuring the safety of any personal belongings during the shoot.
Photographer/Videographer Responsibilities:
Photographers/Videographers must arrive on time and provide services as per the agreed terms.
Photographers/Videographers are independent contractors and are solely responsible for the quality of their work.
Pixalba's Limitation of Liability:
Pixalba is a facilitator and is not responsible for:
The quality of services provided by Photographers/Videographers.
Lost, corrupted, or missing images or Videos.
Any disputes between Clients and Photographers/Videographers.
Pixalba will assist in dispute resolution to the best of its ability, but the final responsibility lies with the involved parties.
7. Copyright & Image Usage Policy
Client Rights:
Clients retain ownership of the images/videos captured during their session unless otherwise agreed with the Pixalba
Clients may not use images for commercial purposes without explicit permission from the Pixalba.
Photographer/Videographer & Pixalba Rights:
Pixalba may use images/videos for portfolio, promotional and marketing purposes unless the Client requests otherwise in writing.
8. Platform Usage & Prohibited Activities
Users must NOT:
Engage in fraudulent, abusive, or misleading behavior.
Use Pixalba for illegal activities, including copyright infringement.
Attempt to hack, disrupt, or damage the platform.
Upload harmful content, including viruses, malware, or offensive materials.
Pixalba reserves the right to suspend or terminate accounts if these rules are violated.
9. Indemnification
Users agree to indemnify and hold harmless Pixalba, its owners, employees, and affiliates from any claims, damages, or losses arising from:
Misuse of the platform.
Legal violations.
Disputes between Clients and Photographers.
10. Modifications to Terms
Pixalba reserves the right to update or modify these Terms at any time. Continued use of our services after any changes constitutes acceptance of the revised Terms.
